If all you're going to do is use it as an iPod touch then go ahead and update to ios5b1. If you are going to need it as an actual phone then I would recommend you registering you UDID.

I dont think it will ask for a sim since it wont activate anyways unless you have your UDID registered.

Thats understandable but you're trying to update to ios 5 which is beta for developers only and itunes will not recognize your device since it is not registered under a developer account and pretty much render it an ipod touch.

Here, this should show you what I am talking about:
Exploit found to bypass iOS 5 activation allowing non-developers to install | 9 to 5 Mac | Apple Intelligence

You can always use a cheap prepaid sim if you feel you need to have a sim in there.

Yeah i know about that but i mean if i update to ios 5 when it comes out you think is going to ask me for a valid sim?

Well as of right now the bypass activation only works for beta 1 and not beta 2. When the official ios 5 firmware comes out then yes its going to ask you for a valid sim for activation.
