  • Federal Circuit Rules in Apple's Favor in Key Patent Appeal against Samsung


    A federal appeals court recently ruled that Apple has the right to block Samsung from using its patented inventions in its own handsets, This particular decision could have major consequences for future products that are made by Samsung. The Federal Circuit’s decision reads the following regarding the matter:

    The right to exclude competitors from using one's property rights is important. And the right to maintain exclusivity — a hallmark and crucial guarantee of patents rights deriving from the Constitution itself — is likewise important.
    The recent decision is so important that Samsung even had the backing of several major players in the tech space including Google, HTC, LG and Rackspace. Despite the support and it’s argument, Apple seemed to have come out ahead in a split 2-1 decision.

    To shed some more light on the situation, US District Court Judge Lucy Koh previously determined that the damages and licensing fees paid by Samsung were enough for its illegal patent infringement. At this time, Apple disagreed with the conclusion and opted to file an appeal instead, stating that the damages and licensing fees paid by Samsung weren’t enough for its illegal patent infringement. Apple however, felt it should have the ability to block the use of certain inventions as well, a stance that the appeals court ended up agreeing with.

    The Federal Circuit had the following to say regarding the matter:

    This is not a case where the public would be deprived of Samsung's products. Apple does not seek to enjoin the sale of lifesaving drugs, but to prevent Samsung from profiting from the unauthorized use of infringing features in its cellphones and tablets.
    For those of you who didn’t know, both Apple and Samsung agreed to settle all non-US patent disputes last year, leaving the California cases open. As far as the Apple v. Samsung trial goes, it initially ended in an initial $1.05 billion win for Apple. This number was later reduced to $929 million due to a juror error and appeal, and later reduced to $400 million.

    We’ll have to see what impact the recent decision has on the two tech giants but we already know that it isn't going to be doing Samsung any good.

      A few, but none of the important ones. Mainly they’ve won appeals to lower the amount they pay to apple for cases they lost.
