  • Appeals Court Rules that Samsung's $930M Penalty Must Be Adjusted


    An appeals court recently ruled that Samsung’s $930 million penalty, which originally was due to its patent infringement suit with Apple, has to be adjusted in a mixed courtroom outcome for Apple. The US Court of Appeals for the Federal Circuit announced that it has affirmed a jury’s verdict, which found that Samsung violated Apple’s design and utility patents. The appeals court also ruled that Samsung in fact did not infringe on Apple’s trade dress intellectual property and overturned the jury’s findings on that particular issue. The ruling states the following:

    We therefore vacate the jury's damages awards against the Samsung products that were found liable for trade dress dilution and remand for further proceedings consistent with this opinion.
    The appeals court also ended up affirming that the district court’s denial of Samsung’s motions for a retrial. In easy to understand terms, this decision means that Samsung’s $930 million fine will be adjusted (likely reduced) once the trade dress claims are removed from the judgement.

    For those of you who didn’t know, design patents can cover specific, nonfunctional design elements whereas trade dress patents are more comprehensive. In the first trial regarding the matter, Apple claimed that Samsung violated a total of four trade dress patents. Three of them had to do with the iPhone and one covered the iPad and iPad 2.

    Samsung was found guilty of infringement in 2012 and ordered to pay Apple $105 billion. The presiding Judge Lucy Koh then struck roughly $450 million off of that award and set a retrial to reassess the damages. By the end of that whole process, Samsung ended up with a $930 million fine for patent infringement, one which the company appealed once again. Now the company is seeing reduced fines with the recent verdict. We’ll have to wait and see how much the fine is reduced by.
