  • Apple Starts to Send Out Settlement Checks to Eligible Old iOS Device Owners


    Apple previously agreed to a $53 million settlement in a class action lawsuit which involved both iPhone and iPod touch units, where users were denied warranty coverage due to their device liquid damage indicators being triggered. This particular settlement, which covers iPhones that were denied warranty coverage on or before December 31, 2009 and iPod touches denied coverage on or before June 30, 2010 stem from Apple’s use of triggered liquid damage indicators as a sufficient reason for denying warranty coverages. If you check back the dates that spans through, the settlement appears to be limited to the iPhone 3GS and earlier along with third-gen iPod touch and earlier models.

    3M, the company behind the indicators’ acknowledged that the indicators could be at least partially triggered by humidity and not necessarily direct liquid contact. Some owners ended up pursuing a case against Apple for improperly denying warranty coverage. As a result, the company ended up changing its procedures to require additional visual inspection for liquid damage based on devices where the indicators had been triggered. For those who paid out of pocket to replace their devices, the case seemed to continue.

    The company recently outlined on their settlement home page that administrators have finally began sending out settlement checks to eligible claimants last week. One our ModMyi readers, Anthony Wentz received their check recently and shared the information with us (thanks Anthony!). Owners of various iPhone models appear to be receiving checks which range from $180+ to as high as $300 with others receiving smaller amounts for affected iPod Touch units. Those who receive a check have until January 21 to cash out or deposit them.

      I actually had an iPod touch 2g that ran through the wash cycle, but I wasn't denied a replacement.

      Wait....I had an iPhone 3G which I was denied warranty coverage due to the indicator strip being red. I had to give that Iphone up and pay 200 bucks to get a replacement. How come I've never heard of this?? I need my settlement money!

      I received a check for $251.00 even though I put in a claim for more than 1 phone. Apple denied a warranty replacement on 3 of my iPhones at the time, neither of which had any contact with water.

      The attorneys handling this sent out emails and post cards regarding this a while back.
