  • Microsoft and Samsung Set to Go to Court Over a Royalty Dispute

    Microsoft recently filed a lawsuit against Samsung, claiming the South Korean tech giant is not holding up their end of an Android patent cross-licensing contract. Samsung is being accused of failing to pay an undisclosed amount of money in royalty payments which were said to be made to Microsoft. Although the court filings haven’t been publicly released, the company’s deputy general counsel, David Howard, summarized the complaint in a post on the Microsoft blog. He wrote the following regarding the matter:

    After spending months trying to resolve our disagreement, Samsung has made clear in a series of letters and discussions that we have a fundamental disagreement as to the meaning of our contract.
    Like many tech giants nowadays, Microsoft secured several patents and intellectual property licensing deals with various manufacturers. Back in 2011, Samsung agreed to pay Microsoft royalties on sales of smartphones and tablets running the Android operating system. This was a deal that the company apparently decided to break as they never actually paid their dues. Howard claims Samsung is trying to sidestep the contract by claiming that Microsoft’s acquisition of Nokia made the agreement invalid. Howard had the following to say regarding this matter:

    In September 2013, after Microsoft announced it was acquiring the Nokia Devices and Services business, Samsung began using the acquisition as an excuse to breach its contract. Curiously, Samsung did not ask the court to decide whether the Nokia acquisition invalidated its contract with Microsoft, likely because it knew its position was meritless.
    Samsung hasn’t issued a response to the accusations but Howard feels that a conclusion should be reached in court rather quickly. We’ll have to wait and see what ends up happening.
