[How To] Check if you can Unlock
There are a few ways that you can check if you can unlock. First thing is to check what baseband/modem firmware you are on:
1: Go to settings-general-about and and scroll down until you see modem firmware.
or
2: Download f0recast from here: iH8sn0w.com | Jailbreak your iPod touches and iPhones. Run it with your phone connected and it will tell you what baseband you have.
or
3: Download Tiny Umbrella from here: The Firmware Umbrella - TinyUmbrella. Run it and click on your phone, you should see it under "installed baseband".
Use #2 or #3 if you are at the emergency screen and cannot access the phone.
Once you know what your baseband is you can check here if it can be unlocked:
iPhone 3G/3GS

Baseband Cannot be downgraded unless you have a iPhone 3G that has a 5.8 bootloader. f0recast/tiny umbrella can tell you if you do. If you are lucky enough to have this then you can use Fuzzyband in cydia to downgrade your baseband.

Baseband can be preverved when updating two ways:
1. Restoring to custom firmwares made with pwnage tool or sn0wbreeze. Tutorials can be found here::

There is a way for you to unlock now using a method of updating your baseband with a custom firmware made with pwnage tool or by using redsnow to update the baseband for you. For full info using this method read here VERY carefully (especially the part about loss of GPS): Dev-Team Blog
DO NOT attempt this if you have a 3GS with a serial number XX135 or later. The one stands for 2011 and the 35 for week 35. So 3GS's made after week 35 of 2011 cannot install the iPad baseband. This should be just the 8gb version 3GS as they were the only ones being made at that point I believe.

Unlockers should use custom firmware or Tiny umbrella method (iPhone 4 only) 99% of the time when updating/restoring. The only exception is when it is confirmed that the latest firmware has a baseband that can be unlocked. (Thx blkcadi & Mes

3Gs can be unlocked at 4.1 with a custom firmware maintaining the baseband and use ultrasn0w I thought....mmmmmmmmmmmmmm

It can. This thread just covers what baseband comes with which firmware. Using a custom firmware will preserve baseband to maintain unlock, so it doesn't necessarily mean you can't be on 4.1 and be unlocked. Just means if you're already on stock 4.1, the baseband that came with it is not unlockable at this time.

Lol, ya as puma/Annie said I was just putting what baseband comes with each stock firmware. I will add a bit to the end saying how custom firmware (and tiny umbrella on iPhone 4) can preserve baseband...in the morning
