unlock an AT&T active phone

ok I have a jailbroken 1.1.4 currently active with att. I really want mms so my idea is this can I call AT&T and change to a different phone and then unlock and use my sim from my other phone and add smart phone package to my account and get mms to work

You will not get MMS working on AT&T. After you put your SIM card back in your iPhone it will get picked up when they do the system sweep and within 48 hours you will get blacked again.

even if my iPhone is not in the system basicly AT&T doesn't know I have it anymore

Try if you'd like. I have read through hundreds of posts about people trying to "trick" the AT&T system and as of yet it's never worked for more than 48 hours.
