Upgrade but cut data plan

Ok I have a 3g and I am on my own plan. My parents also have At&t and they have a phone upgrade in June. I am wondering if At&t will let me buy a phone using the upgrade discount on her line, and then give her my iphone (to use as a touch she doesnt want to pay for the data plan) and she can go back to using her old phone, and I will be able to use the iPhone on my plan. Has anyone done this? Does this make sense what I am asking. Any help would be awesome. Thanks in advance.

No, they wont let you "swap" upgrade eligibility.

What if she pays for it for 1 month then says the phone breaks and she wants to go to her old phone. Then can it work?

Nope. They are a little brighter than that.

If you cancel the data plan and take the iphone off of that line, you pay the "early termination fee".

Your not the first one to try and scam ATT, I can assure you they have thought about all the angles.
