    They know because of the IMEI. They can see it even when you make calls. Only the 2G had something to change the IMEI but it is also illegal to change the IMEI of a device.

    Same here, they haven't complained to me about it yet.

    My account also has manually entered IMEI for unsupported devices, seems like that keeps the auto scanner at bay.

    I used to use an Acer Liquid, that is still on my account when I call, and when I log in on the site I can see it is a 3GS.

    So they can see it, but it seems the manually entered one creates some sort of a loophole.

    From research I did on this this hack it could only be done back with the 1.1.4 firmware and then update to custom firmware that won't change bootloader. In other words as high as you can go is 2.2 ipsw? Is that true?

    They can and do force you to use a data plan with not just iPhones but any smartphone. All smartphones must have a data plan and it is written in their contract. AT&T is not the only carrier that does this, they all do the same thing for smartphones.

    When you call them to add the phone to your account simply give them the IMEI from another phone instead of the iphones IMEI, then simply put the sim card into your iphone and your set. that way they wont force you to use a data plan since the ericcson shows on your account and not the iPhone.

    But the problem is that ATT does "scans" of IMEIs of the phones being used and if it detects a smartphone it will add the plan automatically. And not just scans of information you have given they take the last IMEI that your phone connected with; either with data or voice.

    My girlfriend is using a 3GS without dataplan. Today, she received a message stating that the dataplan has been added to her phone. This is the 2nd time ATT added the plan automatically. 1st time, we called, they credited back the charges. This time, we called and asked to take out the dataplan because we never sign contract for it. They did take out the plan.
    This kind of odd because my sister in laws is using iphone without dataplan as well, we have 3 iphones and 2 other phone sharing family plan.
    My iphone has dataplan
    My gf iphone is without dataplan, which ATT has added the plan automatically 2 times already
    My sister iphone is without dataplan, so far ATT has not done anyhting with it.
    Question is why ATT has not done anything with my sister's? It's kind of annoying to call them everytime the dataplan is added without knowing anything.
    Is there anyway we can do something to avoid this? If not then the only option left for my gf is to use a non-smartphone which is suck cause she really likes to use the iphone but no need for the dataplan.

    When did you sign a contract? If it was within this year then you signed a contract stating all smartphones will have to have a data plan.

    Ah, that's probably why...we added my girlfriend line some time in Jan of this year..
    If ATT adds the dataplan for the 3rd time, we will probably go for the cheapest plan $20/month so that she can uses the iphone.
    $20/moth is the cheapest dataplan right? Anything cheaper than $20/month for iphone dataplan?

    I think the 200mb is 15$ a month. the 2 gig is 25$.
