There are ways around it. For example, if you were to get a 3G capable phone from AT&T, and then swap the SIMs with the one in iPhone 3G, and also 'swap' (if you know what I mean) the IMEI numbers, then AT&T would think that you still have that 3G capable phone, not the iPhone. I don't know if one can change the IMEI on iPhone 3G yet or not, but that would be one way. I just wouldn't mention anything about an iPhone 3G to AT&T, so they don't suspect anything.
