help, contract breach ideas, would it work? what happens?

ok, say i'm eligible for a new contract with At&T and get the iphone 3g, can i get out of an E-T-F, if i say i moved out of the country, and have proof of another carriers phone bill?
or, if i have a friend (old, careless about phones) that has at&T and is eligible for an upgrade, i want to get iphone 3g, is it possible to get it without adding the data plan (if buying at apple store, cuz at&t gets paid commission and wont whatsoever) pleading that i have no intentions at all of using any data, just want phone and ipod in one device. its still a 2yr contract extension but no extra fee
or if i just get new contract in my name and get the 3g, what can they do if i cancel after 30days and just dont pay the ETF??
