Illegal to use team logos in themes?

I was just wondering if it is illegal to use team or company logos in themes. I know it's legal if you are not selling the theme, but it is illegal if I ask for donations? How about if I say "I will make you a team logo carrrier icon theme for a donation?" If someone is familiar with those rules please let me know, I don't want to get in trouble for using trademarked photos in themes.

My guess would be that if you use someones image/logo, there may be trademark issues. I would suggest not using it if you plan on making a paid theme.
