they've been trying to do this since jailbreaking was introduced. it's not happening.

Umm.. yea. Where have you been?
Even if they do make it illegal I'm still going to JB my iPhone, especially since I need to to even make calls!
It's not like they're going to go through every iPhone in the world and arrest anyone with a jailbroken iPhone or anything.I always feel sorry for the guy in the iPhone commercials. He always gets a call right in the middle of trying to do something

It will only create ill-wills against Apple as a company.
If I'm Apple, I'd just simply just PRETEND to fight for the interest of AT&T but intentially leaves holes for hackers to still jailbreak. They surely must realise that jailbreaking actually opens up potential for more iPhone sales. Many of us would'nt touch an iPhone with a pole if it can't be jailbroken.
The same goes on in the window mobile world. Microsoft's winmo is so bad that it really is reliant on the a famous website guys to make it interesting, and make a community out of ROM cooking that attracts a large user base. Both Microsoft and HTC knows that website's works (which were initially labelled as fringing copyright, blah blah blah) are something that "they can't live without" after all.

Honestly, either Apple can decide to actually make an iPhone that lives up to its full potential like a jailbroken one, or people will find away around it. Illiegal or not people are still going to do it.
