He wants $400 for it is that a good price or should i talk him down

I'd buy it just to toy around on and I already have one. They're solid computers.

I bought the same model, but upgraded to Snow Leopard with all the software addons (Office, Aperture, iLife, etc.) and a bunch of extras & upgrades for 600 back in April.
