    Default Samsung Pulls Injunction Applications against Apple in Five European Countries


    Samsung recently announced that it will drop patent injunction applications filed against Apple in five different European countries, although a number of lawsuits alleging patent infringement remain intact. A senior executive from Samsung ended up telling The Wall Street Journal that injunction applications filed in the U.K., France, Germany, Italy, and the Netherlands will all be pulled from court. All of the injunctions that were pulled were related to wireless telecommunications technology.

    The applications that were withdrawn are a major shift in the war between the two tech giants, where court filings and disputes have piled up in dozens of countries around the world. The South Korean electronics manufacturer’s withdrawal of injunction applications was “unilateral and voluntary,” and the company declined to say whether they came as a result of out-of-court talks with Apple. According to Samsung’s statement:

    Samsung remains committed to licensing our technologies on fair, reasonable and nondiscriminatory terms, and we strongly believe it is better when companies compete fairly in the marketplace, rather than in court. In this spirit, Samsung has decided to withdraw our injunction requests against Apple on the basis of our standard-essential patents pending in European courts, in the interest of protecting consumer choice.
    This announcement comes shortly after Apple was denied a motion in the U.S. for permanent injunctions against Samsung devices found to have infringed on certain design and utility patents. It seems like luck has been on Apple's side when it comes to patent infringement accusations against Samsung, with the most significant being when Apple was awarded $1.05 billion by a jury in California.

    Think this is more of a case of both Samsung and apple realising that the courts are feed up with the two companies and will now just fight it out and hope they win the patents case

    I think Samsung has realised that they aren't going to win anything and would rather end the litigation whilst saving themselves money whilst gaining some positive publicity in the process - a good move in my opinion.
