Piracy, yes. Themes, no. You can tell its an iPhone just by looking at it. It has a unique look.

Themes also slow down the device. It's not that big compared to pirating but I think Apple wants to keep their sleek cool devices as fast as possible. Too much tweaks installed slow down the device also.
