jailbreak a brand new ipod

My little sister has bought an ipod from argos. its been untouched for 4 weeks (her internet was off so wasnt able to get itunes) she now has internet up and running and wants to activate it and jailbreak. the advert in argos states the ipod is running 3.1 but we have no idea what gen. (im guessing 4th gen as she only paid £140 for it so it cant be 5th gen right?)
So im going down to activate it and then jailbreak. im gussing it will want me to update? ill just keep it on 3.1 then what jailbreak do i use? jailbreakme from what ive read would work.
any guidance would be great as ive never used an ipod before.

4th gen is the latest. So it is either a 2nd gen or 3rd gen most likely.

realy? i thought 5th was on the tv adverts now? (i forgot to say its ipod touch) so if it is 2nd or 3rd then which jailbreak should we use? thankyou xx

Well jailbreakme.com hasnt been working of late so thats a no go. Use tiny umbrella to see what shsh you can get for it. It may be able to tell you what generation ipod it is too.

again, sorry to sound dumb, but how would shshs help me? is 3.1 not jailbreakable? cant i just activate the ipod with itunes then jailbreak with redsnow then? xx

Ya you can jailbreak it with redsn0w but you would need an older version and a lot would depend on what generation ipod it is and what the model number is. It can get very confusing with iPod touches.

an older version of redsnow? so we think its 3rd gen. so which redsnow would we use? and is it the same process as jailbreaking my iphone with redsnow? thank you so much. xx

If it is a 3rd gen then if you have to restore you will be forced to go to 4.2.1 without having SSH. I am not sure exactly what jailbreak to use on 3.1 for that for it to be untethered. maybe spirit but if you have itunes 9.2 or higher installed you will need the fixed version for it to work. Thats why I was asking about the SHSH. If you can get 4.1 SHSH then you can restore to that and have a few choices for jailbreaking.

Spirit worked, it was running 3.1.3. I saved 3.2.3 up to 4.2 with tiny umbrella too. Thankyou for all the help again.
