We now (think we) understand the new restore process -- the iPod Touch now requests signed images from iTunes, making it much harder to jailbreak in the same way we did with the iPhone.
On the other hand, we have been successfully able to read several files from outside of jail, by putting the ipod touch into an elusive pseudo-restore mode we call MartynMode -- after the developer who accidentally stumbled upon it. We have yet to understand exactly what is happening on the iPod Touch side -- but MartynMode gives us some hope that we will be able to jailbreak after all.
We have succeeded in looking at the console information during restore by modifying boot parameters... Erica posted some pictures here: http://www.tuaw.com/photos/grestore/
We have also confirmed that it is possible to change the path to the kernel to load, so that it boots up using a different kernel... We suspect these kernels are encrypted however, and this process is quite risky (I bricked my iPhone trying it ).
Currently we are in the process of taking apart a broken iPod Touch (thanks for the donation!), and dumping the contents of the flash... from this we should be able to get the complete contents of the root partition of the iPod. Access to these files will be a significant breakthrough -- giving us much more information to search for a way to jailbreak from.

Windows is not a virus, viruses do something.

Is this development in direct relation to the upgraded iPhone firmware?

No. Read which forum you are in. This is specifically for the iPod Touch, NOT the iPhone.

Just saying this is the iPod Touch firmware, NOT the iPhone. Two separate things.
