Well if your home button is messed up, then thats a major hardware issue. You could try a normal restore without DFU and see what happens. But you definitely have to take it into apple to get it fixed.

but i thought you cant cause its hacked and they dont except hacked itouch

That's why you have to restore. They can't tell it was *jailbroken* (not hacked) if you restored it.
