Power button jammed

I'm not sure if it was being in a pocket with some sand in it, or from dropping it on concrete, but my power button got kinda jammed. It still works, but it's not very responsive when i press it. It doesn't click. And i'm worried that it's causing random shutdowns. I jailbroke it on 3.1.3, but if i restore it, will i be able to send it to Apple if it's been 3 months since purchase? Or is there an easy fix?

If you have an iPod 2G, this is kind of a known issue. Not many talk about it, but I also own a a 2G that has that problem. I kind of pushed it up a little when I took off the digitizer from a crack. It didn't do much, but not it's not totally sunken into the casing.

Can I send it to apple if I restore it?
