So are you on an iPod or an iPhone?! In the title, the info in the top right, and the firmware, you say it's an iPod, but later and in the pictures, it's and iPhone! Please elaborate!
Anyway, I need some more info:
-What are you doing when the device freezes? (Does it happen when using an app or at random?)
-Have you seen the files of the themes (SSHed in and looked at them)? Otherwise it's just that the file for changing the icon doesn't exist, therefore it's normal.
May just have to wait until some messages pop up or reload the springboard for that red dot to leave you.

Did you change themes or were they just back to the stock image one day?
And about the rebooting; if you want to get rid of it (at the cost of setting up all those apps on your device again) you should DFU restore. That wipes the entire device clean, so if it's a software problem (it's highly improbable that it's hardware related, though), we can rule that out.

Well unless I am wrong one of your problems could be that your running the iphone software on an ipod touch.....

Well, that shouldn't happen since if you try that, you get an error! I'm guessing it's an iPhone theme-er.

it might be the theme. install customize and just go back to default. Then load the theme again.

Well, it could be Cydia (it could be almost anything with apps).
No, pressing the 'Restore' button in iTunes is not the same as DFU mode. DFU mode is something when there's a catastrophic error, or you just want to completely wipe the device (which is what it does). Restore through iTunes is just a "reset", which just cuts off all the fringes but leaves the core in tact throughout, which might work, in your case.

The red dot on the phone is like that...
After you first put on the Activation and Prefs, then Reboot your Touch, it will show that dot.
Its not Customize, Winterboard.it might be the theme. install customize and just go back to default. Then load the theme again.
You need to ssh into your iPod and replace the missing icons

how do you have the phone and sms options on your ipod touch i mean how did you get the icons And how do you go into DFU mode
