Apple keep on saying it's illegal in the hope that someone will believe them.
It has never been tested in court but neither I nor the Dev Team believe it is illegal otherwise we wouldn't do it.
The EFF do not believe it to be illegal and want it to be specifically excluded from the DMCA which is why Apple are making a big fuss trying to convince people it is.
The law is unclear and hopefully it will be clarified and jailbreaking will be specifically excluded from the DMCA.

I cannot locate the firmware there is no Application data file. I've looked through every file in my folder cannot find it. I've done a whole computer search and cannot find it. I'm a little puzzeled.

Try showing hidden files in your settings (google it)
