    But how many people using beta 3 trying to update to beta 4 OTA are non jailbroken?? As I stated before it will not work this way.

    But yes you are correct. Technically the jailbreak will work if you successfully updated OTA and want to jailbreak and weren't jailbroken before. It will work if you manually updated in itunes regardless.

    Since Jailbreaking has been deemed legal by a branch of the US Government, isn't what Apple doing then illegal, by interfering with a legal process?

    Jailbreaking is deemed legal but the software (firmware) still belongs to Apple and so they are gonna try every effort to block jailbreaking it.

    Its all for personal gain if you ask me.

    Because when you install a custom firmware there are no unusual apps in /Applicatons, until after cydia is installed, by that time it's to late to check & the with OTA updates you already have cydia installed, so they can check.
    Apple are Control freaks we need to stop them before they take over the world!!

    There wasn't ever anything to check. before, all updates required essentially reinstalling the entire OS. None of your settings were saved (that was up to your iTunes account on your computer).

    absolutely not. Jailbreaking is legal, so they can;t sue you for jailbreaking. They can do whatever they want in terms of updates. Your warranty is still (technically) voided when you jailbreak, and no law is going to change that.
