    Default Nokia Sues Apple For Patent Infringement


    The Finnish cell phone manufacturer Nokia has sued Apple, claiming in the U.S. District Court in Delaware the iPhone violates ten of Nokia's patents of GSM and wireless technology.

    In a press release announcing the lawsuit, Nokia notes that it has invested over €40 billion in research and development in handheld and wireless LAN technology. Nokia claims that Apple refused to license Nokia's technology, pointing to the fact that 40 companies are now paying license fees for the use of Nokia's intellectual property. “By refusing to agree to appropriate terms for Nokia’s intellectual property, Apple is attempting to get a free ride on the back of Nokia’s innovation,” said Ilkka Rahnasto, Nokia's VP of Legal & Intellectual Property.

    Analyst Gene Munster with Piper Jaffray says he believes Nokia is taking Apple to court as a hardball move to press Apple to start making royalty payments, stating that Nokia and Apple have been in talks over this issue for more than a year. He said that he believes that Nokia will settle for a 1%-2% royalty, which he says would amount to $6 to $12 for each iPhone Apple sells.

    Deserving...I mean Nokia is the co who originally started GSM technology and it is already evident with 40+ companies endorsing mutual agreement of royalty, So when you are using a developed technology, why don''t pay it? Apple really sucks!! A4$ make us pay a bomb for a phone that doesn't work with other carriers.

    Nokia hasn't sued YET, they only filed.

    I think the whole thing is pretty lame. Nokia is sailing away on the failboat and suddenly after the 3rd generation of iPhone they decide it infringes on their patents. Now it's possible Apple and Nokia have been discussing a contract to license those technologies and finally told Nokia no because they were demanding to much money.

    Patents are starting to get in the way of progression of technology, and it really needs to stop. Just because you have idea shouldn't mean someone else can't have the same idea AND implement it and make money. Sitting on the worlds next best thing with no way to create it is, simply put, STUPID!

    I recall reading something about patents that aren't being used expire after X years, same with ones that are in use, but they last longer. I think if you can't show that you can actually make and sell something, you can't patent it.

    Just my 2 cents.

    Lame. Here's a hint Nokia, make better phones. Make an "iPhone Killer" that actually deserves the name, unlike the countless failed attempts of everyone else.

    This won't affect apple at all... I don't know why Apple don;t wanna pay nokia for using "their ideas"... it is simple, if Aplle lost this battle they just raise the price on the iphone and make the same profit, I think Nokia is right, they patented something and if anyone else wanna use itm they have to pay, just like all other phone manufacturers... why make an exception with iPhone??

    It should be like that cause these kinds of arrangements do take time.

    You would realize the pain of this if you put your hard earned money into buying something really expensive and it gets stolen and the thief boasts about using it with something else and u can't do anything about it.

    Having one great idea doesn't necessarily mean you have all the genius ideas in the world. We won't have had sooooo many scientists and researchers in the whole world then. It would have been just a single KNOW IT ALL person.

    Patents does not expire and the inventor can keep earning benefits as long as the technology is in practice. and Nokia has made it and showed it to the whole world already. Don't forget that they are the largest smartphone maker in the world.

    Sure, maybe Nokia waited a long time, but regardless, 40Billion in research to come up with the wireless technology for GSM, if they produced it, they deserve it. And it's pretty much an undisputed royalty, everyone pays. I'm sure someone at Apple will say "ok, you caught us, here ya go" and we'll never hear about it again.

    1. U.S. Patents filed after June 8, 1995 expire 20 years from the date of filing.

    2. U.S. Patents filed prior to June 8, 1995 expire 17 years from the date of issue, or 20 years from the first non-provisional patent application in the family - whichever is later.

    Maybe just a publicity stunt by Nokia to buy some time? Make Apple look "EVIL" so everyone will throw away their iPhone and go buy a crappy Nokia.

    Apple would do the same with with all of their absurd patents. At least Nokia actually has a valuable technology worth patenting unlike the way Apple railroads people into paying royalties for using finger gestures. Well, I have a one finger gesture for Apple, and they don't have the patent on it.

    I don't know about this. I was ALWAYS a Nokia guy. Nokia voice quality, call reception, battery life, 3G (my euro phone was 3G and MMS back in 2006 for 220 euros [I think a model 6630 but I can't remember the model number now]), and speakerphone all blow Apple out of the water.

    I love my iPhone, but voice quality is average, call reception/antenna is lame, battery life is OK (but cannot be swapped) and the speakerphone is "not its strong point".

    So... if Apple is copying Nokia, WHY DON'T THEY AT LEAST COPY THE STUFF THAT NOKIA DOES SO WELL!?!?

    Good luck, Nokia, and may justice prevail to whomever is in the right.

    Does Microsoft pay Apple every time they sell a copy of Windows? Didn't think so.

    Nokia's argument is invalid, and the judgment will be random, because somehow these high-tech intellectual property cases are always tried by the most technologically illiterate judge the judicial system can dig up.

    **** Nokia for whining.

    If Nokia wins this, it should immediately overrule Apple v Microsoft, and Microsoft should cease to exist. But that would only happen in a fair and logical world.

    Right, for all the people who are ******** about nokia here, look at it this way, and if you can't see it this way, maybe you shouldn't open your uneducated traps:

    If you personally patented something that is going to be used by several companies in all their phones, how would you like it if 1 company STOLE the idea behind the patent and didn't pay you royalties over it, in every single phone they sell, and if it is the most SUCCESSFUL phone of all time selling millions of units, thats how much money you have lost personally due to 1 company dodging paying for an idea which has been patented.

    Not only is it simple business practice, it is also basic manners, and don't start on Apple vs MS, cause they both have ripped off linux and unix so many times its become a joke, so if anything apple and ms should cease to exist and we should all be using linux systems. but since linux is open source and THE BEST collection of operating systems out there that do not fail and do not get hacked, the point remains mute.

    Apple has been getting worse every year. They have great products but they release them to early and miss out on very simple things and tasks that other companies have. I miss the Apple that we used to have. Not this new one. Who makes it hard for someone to buy a phone and the phone has many issues. I've had a for 6 years now and I said i'd never go back to Microsoft but im considering.

    Just that, when it is public knowledge and can be recreated for each device. A perfect example is Nokia who effectively spent the engineering money and CREATED the GSM technology (for phones to connect to cell towers). Everyone who uses this owes Nokia some money per sale.

    Now the phone makers who use CDMA for transmission to cell towers owe Nokia nothing.
