Tris: Game Over!

According to a recent post at Tris blog, the developer announces that this game is over! The developer has received a notice from Apple, who have been contacted by the owners of the Tetris copyright and have requested the developer remove the app.
Download the app while it is alive on the appstore! Sorry Tris and Noah, we will miss you!Well — I've received notice from Apple that they've been contacted by The Tetris® Company about Tris. That, I'm afraid, is essentially game over. Do they have a case? No. Not really. I am convinced that if it went to court, the "copyright" claim would get thrown out completely. The trademark, perhaps not — but if I changed the name, to e.g. “Trys”, that would be much harder for them to argue. The trouble is, I'm a college student, and not an affluent one, and I simply do not have the time, energy, or resources to fight this battle right now.

Wow, that is pretty ridiculous, esepcially considering that it's not like the real creator of Tetris is going to release an official iPhone version. This game was really well designed, and I nabbed it a week or so ago when I saw it climbing the top 25. And also he isn't making any money off of the game, so what is the problem here??
He should take it down, wait a week, then repost the same program with a completely different, generic name like 'falling blocks' or 'block puzzle' or even something unrelated like 'tortoise'

surely you can get hold of the app, and SSH it to your iphones? Or wait for it to be out on cydia

Tris was available over installer on 1.1.4, surely it could come back to cydia now =/
I don't play Tris anymore as I have the official EA Tetris app off Appstore which I prefer, but Tris is great and doesn't deserve to crash and burn. I agree with the guy earlier, rename it to Tortoise!

Is it considered intellectual property if the idea is the same but the name is different? And as the developer said, its not a winnable case for EA, but they surely can drain his time and money to force him to quit. But wouldnt this have to presented to a judge first, to determine if these folks actually have a case?
And isnt this the same kind of thing as say Generic Groceries vs Main Labels? Its never good or better than name brand, but it serves the same purpose.Last edited by Muggz5; 08-27-2008 at 05:22 PM.

@ crupp: No, the killswitch is only for malicious apps and we'd be very lucky if Apple ever uses it since their initial screening is ok for the most part.
@ Teh H4RrY: It's ok to take off your tinfoil hat, the only reason the Killswitch exist is to protect your information.
