It should be the same price for everyone. Apple and AT&T have to "assume" that if the phone is sold it will be used with a legitimate service provider. Apple is banking on this because they will make up for lost profit with the service provider kickback.

Why are people with 1st gen screwed? You are screwed, as you have sold your phones and now you can't buy a new one without contract as they are enforcing the contracts now. If anything the price of 1st generation will go up.
