Lower Chinese Court Rules Against Apple, Asks for Halt in iPad Sales
On Monday, news emerged from the far east that a lower court in China has ruled against Apple in the ongoing legal battle between the iPad-maker and Proview, the Shenzhen-based company that claims to own the trademark rights to the "iPad" moniker in China.
According to scant details confirmed by the Associated Press early Monday morning, Proview is claiming a "small" legal victory by virtue of the lower court's ruling, which effectively judged against Apple's continued sales of the tablet in China.
Unfortunately for Proview, however, the ruling may not have much widespread impact. As MMi reported last week, initiating a commercial ban on iPad sales would be immensely difficult in China today. What's more, Apple's case is still pending in mainland China - the outcome of which will be substantially more effectual than the determination of the lower court this morning.
Apple, meanwhile, maintains that it holds the trademark rights to the iPad name in China. "We bought Proview's worldwide rights to the iPad trademark in 10 different countries several years ago. Proview refuses to honor their agreement with Apple in China and a Hong Kong court has sided with Apple in this matter," Apple spokeswoman Carolyn Wu said.
