Australian Courts Shoot Down Apple's Appeal, Samsung Rejoices

Turns out Samsung might have a happy new year down under after all.
The Australian courts shot down Apple’s appeal that would have reinstated an injunction against the Samsung Galaxy Tab the Australian courts recently lifted. While this doesn't mean Apple has no grounds for an appeal, it is essentially a vote of no confidence from the High Court that an appeal against an earlier Federal Court decision would succeed.
The ruling reverts to the status quo and allows Samsung to sell whatever model of the Galaxy tab they want, but Apple’s lawyers could still create headaches for Samsung. Apple and Samsung’s full hearing over the patent dispute isn’t scheduled until sometime next year, and Samsung must keep detailed records of Galaxy Tabs and Apps sold. The courts seem to have little confidence in anything coming of the suit though, noting that the short lifetime of tablets and the far out court date accompanied with the lengthy legal process would result in both parties moving on before a decision needs to be made.
Samsung announced Galaxy Tabs will be on shelves Monday morning with prices of $579 for the 16GB WiFi Galaxy Tab 10.1 and $729 for the 3G version.

Victory? Rejoicing? A 6 month old tablet finally able to be sold in one of the world's smallest markets?!?! nothing to rejoice about, and when are those compensation checks from apple going out in the mail?

Doesn't matter. Apple lost.....period.....and Samsung will be able to obtain revenue that wasn't there before.
If its nothing to rejoice about and Australia is such a small market.....then why did Apple spend so much time and money with the lawsuit anyway?
Funny.....every time other companies file lawsuits against Apple and lose Apple fans "rejoice" and laugh it up in their face.....but when the situation is flipped then it just becomes a "meh...whatever" attitude for Apple fans.
Shouldn't matter much to Apple anyway....theyre doing just fine with the iPad with or without Samsung sales.Last edited by RICO_; 12-09-2011 at 06:48 AM.

Wait I don't get it, was the appeal from High Court to Federal? I always though High court was the dead line.
