    Default Australian Federal Court Overturns Galaxy Tab 10.1 Ban



    The Australian Federal courts ruled in favor of Samsung’s appeal to a previously Apple won injunction against Samsung's Galaxy Tab 10.1. Australians can finally love themselves some Galaxy Tab 10.1 again.

    The court unanimously overturned Justice Annabelle Bennet’s ruling last month that banned Samsung's Galaxy Tab 10.1 from being sold in Australia. According to the ruling Samsung will be able to launch the Galaxy Tab “provided it keeps accounts of all transactions involving that device in Australia." I didn’t realize tablet makers sold their devices via a seedy tablet black market.

    Samsung’s jubilation is only matched by Apple’s disappointment. Apple plans to appeal the decision bringing the case to the High Court. While the court has lifted the ban the injunction will remain in place until Friday at 4 p.m. per Apple’s request to allow time for the company to file an appeal.

    Samsung is safe for now pending Apple’s appeal. A full hearing is still set for March 2012 where the courts could still rule in Apple’s favor resulting in a permanent ban, not just a temporary one.

    Samsung was able to circumvent a apple won ban on the Galaxy Tab in Germany by releasing the Galaxy Tab 10.1N. This new Galaxy Tab is identical to the old sans the addition of a pronounce metal frame around the outside of the device. Apple is already seeking a ban on this revised device with a hearing scheduled for December 22.

    The legal chess match between Apple and Samsung shows no signs of slowing down. The end game is likely a stale-mate between both companies as they shadow the other’s King about the board.

    So then will Samsung file an appeal to overturn the decision to overturn the decision that was originally overturned?
