is the new 3GS jailbrakeable?

I am thinking of going to the apple store with my 3GS as it is cracked and getting a new one. thing is the one i have is jailbroken and untethered on 4.0. What I would like to know is am i likely to get a jailbrakable 3GS as a replacement or is the latest firmware not yet jailbreakable and also what are the chances of it being a tethered jailbreak even if it is jailbrakeable.

Thanks all ill go to apple store for new 3GS today. lets hope apple dont release 4.3 from now till i get to the store lol
