Can Apple know if you have jailbroken?
Well I was wondering this because a few people said that Apple can tell if your jailbroken through iTunes sync. Is there any way for Apple to find out if your jailbroken or not?

Apple can tell. But they have yet to use it against anyone. Orby may be on later to get into tech detail but has to do with error reports/logs of when you DFU and restore.

I sync all of my jailbroken iPhones through iTunes and have never had a problem.

So if I restore and send in my iPod touch 4 for repair like the screen has been damaged will I be fine?

If you hand Apple a device (say, an iPod touch) that was plugged into a computer connected to the Internet exactly once to activate, saved its blobs, jailbroke it, and then took both the device and its iTunes paired computer off the net completely, Apple would have no way to determine if that device was jailbroken--error logs aren't saved device-side after a DFU restore, and every piece of the firmware would be stock.
With an iPhone, however, they can tell if it's unofficially unlocked (and thus jailbroken) with insane ease. Any time a push comes to you (particularly) over the cell network, they can tell by external IP address and push certificate (they are signed by IMEI/serial number with expected IMSI/ICCID from activation) if your IMSI/ICCID differ from what you activated with and what is expected for the network you're locked to. They theoretically can tell by any means that queries IMSI/ICCID, but only for unlocks. For jailbreaks only, the above paragraph applies.
Again, this is all before any crash reports, console/kernel logs from either iTunes or the device, or external Exchange servers (ActiveSync can detect MobileSubstrate, shockingly) sell you out. Or something as simple as a signed USB request comes in asking (ls -la /Applications). Heck, even Skype has a MobileSubstrate check in it.

and don't be stupid. The only reason I can theoretically see Apple digging like that is if you sell out a corporation secret's from their corporate-bought iPhone (and probably only Apple cares enough to dig if it's their secrets).

A little confusing. So I WILL BE SAFE IF MY SCREEN BREAKES AND I HAVE TO SEND IT INTO APPLE AND I RESTORE BEFORE I SEND IT IN. WILL I BE SAFE

Odds are yes, you will be safe (unless you have a mismatched baseband, e.g., 06.15.00 on any iPhone 3G(S) or 01.59.00 on an iPhone 4 with 4.1.
However, if your screen is cracked, your warranty is almost guaranteed to be voided, and therefore Apple will not replace it. Caveat emptor.

I'm talking about it having a crack in the screen like I dropped it. Would Apple check if I was jailbroken because I always know to restore before sending it in.
