hi there i need help jailbreaking and unlocking it, its on 3.1.3 newboot rom if i try to DG it to 3.1.2 i get 3149 in itunes , if i try to UPG to 4.0 i get same thing can i get some help?

Without SHSH if you try and restore you will be forced to 4.2.1.

and what can i do if i go to 4.2.1?

You would need to use a custom 4.2.1 made with pwnage tool so that your baseband is preserved. The only problem is that the jailbreak is tethered right now on 4.2.1 for new bootrom 3GS.

Go download tiny umbrella, plug your iphone in and click save shsh. See what shsh blogs you have. If you have jailbroken your iphone awhile ago and have click Yes to make my life easier, you should have some shsh blobs.
If you do have 4.0 or 4.0.1 or 4.0.2, then you can restore to any of those firmware.

well right now the phone wount go past "connect to itunes logo" i cant restore to no firmwire "currently downloading 4.2.1" i tried tiny notting i tried everyting i know and same thing, im a just let itunes update it and see if it will take the update.

Then you have to find out your ECID first and then input into Tiny Umbrella. You can use USBview to find out.
Run UsbView, check config Decriptors and hit f5 to refresh.
Scroll down to the apple connect device and highligh it, on the right pane , you will find 16 digit ECID number.
Copy the number or write it down and input into TU and click save shsh .

You can retrieve your ECID in recovery mode.

OR

Click Start > Highlight Computer > right click > Properties > Device manager > USB universal Controller > Apple Device > Right Click > Properties > Details > Device Instance Path > slider your bottom slider to the right > Write down your 16 digits ECID number and input into Tiny umbrella to retrieve all your saved shsh blobs

Run tiny umbrella and input this ECID and click save shsh, you don't have to plug in your iphone to do this

If you have those shsh blogs mention, then you can restore to stock firmware or even custom firmware.
Let's say you want to restore to 4.0, then highlight the 4.0 shsh blobs, start Tss Server, and open up itunes : shift + restore to 4.0 ipsw.
You can check the progress under Log option.

this what TU gave me. now this is my last question to you, Do i have to Restore to 4.2.1? or since i have the shsh files i can restore to any FW?

Yes, your only option is 4.2.1 and nothing else, sorry. You must have done your jailbreak only at the time when apple is signing 4.2.1 which is recently.

Those sellers especially on Ebay before they sell it , and did their jailbreak and unlock it at the time when apple is signing 4.2.1. You should have ask whether there is any shsh blobs. If they don't reply to you on Ebay, it means they don't have it, just wanted to get rid of this iphone and pushed the problem to you.
It is dangerous like your case, if you have problem and needed a restore, this is what happen, you can't stay at what you are at and are forced to go to 4.2.1.
Now you learn a lesson and know how to buy a used iphone professionally.

When you buy a new iphone, before you do any jailbreak, plug it in and run TU, click save shsh , all present and future shsh blobs will be saved and you can do your jailbreak anytime at your convenience.

If you haven't restored to stock 4.2.1, then use exit recovery from the feature of TU to kick it out, then you will be back to your original firmware.
