When you are putting the phone in dfu mode for the redsn0w jb dont let go of the home button on your phone until the jailbreaking screen appears on your phone.

the jailbreaking screen isnt coming up.

You got it downgraded to 3.1.3 I assume? If so just go to JailbreakMe from the phone and jb it that way and save yourself the headache.

No the downgrade stop with the 1051 error and I use tiny umbrella to kick it out and it sits in emergency mode.

Did you downgrade to 3.1.3, and now sitting at emergency mode. Then run Redsn0w 0.9.4, you will need 3.1.2 ipsw to point to. Do your count and it will hactivate and jailbreak for you.
