    Default Jailbreaking Illegal?

    Is jailbreaking your iPod Touch illegal even if it is yours and you bought it?

    Good question. Apple seems to think it is however I believe you have the right to do what you want with what you own. However, there is no legal precedent to follow for this. So in a sense there is no definitive answer.

    Just because Apple say it's illegal does not make it so.
    It is not, and never has been, illegal.

    but it can void the warranty as the software executes unauthorized code on the hardware- thus asking the hardware to do what apple does not intend the hardware to be doing- so jb is illegal in the sense that it voids your legal right to claim warranty-

    further- in the software license agreement, it explicity states that the user agrees not to modify the software [either themselves, or using other software that will modify it for them]- but again, all this does is disclaim apples own liability-

    99.99999% chance you aint gonna be arrested, unless your selling pirated copies of their OS on the streets

    It certainly does void your warranty (at least in the USA - in Europe, probably not) but a simple restore will often get your phone back to a point where Apple would never know.
    But you were probably right to mention it.
