Default POLL: Buyer's phone died after 60 days, what should I do?
I sold an iPhone 3GS on Amazon, the iPhone dies on the buyer 60 days later. It was a new phone. The buyer bought and received it mid-November 2012, then e-mailed me today (1/29/2013) which is just a little over 2 months ago.

Amazon's policy is the sellers are responsible for defective items for 30 days from whenever the buyer receives the item. Well it has been over 60 days now, and she even said the phone has been working great up until recently when it wouldn't charge/turn on anymore so she wants a refund. Technically, in terms of return policies and how much time has passed that she has owned the iPhone...I personally don't feel that I should have to pay out of pocket to refund her nor should I pay out of pocket to buy the parts (like a battery or charging port) and do the repair. And what if the phone is beyond my abilities to repair it? Then what? It is entirely beyond my control when something I sell decides to break or not, especially when I know I sent it out it perfectly free of defects.

If it is passed Amazon's 30 day warranty for defective items then you are covered by that. It is not your responsibility to fix it or refund her. Just like with any other sale of any other item once past the initial sellers warranty the responsibility for fixing or replacing the phone should then go to the manufacturer, in this case Apple. It is then on them to decide whether it can be fixed/repaired and at what cost.

I feel bad bc she only had it for 2 months and it crapped out on her lol. But I really can't afford to take back a phone she has used for 2 months so...I agree with you on that Simon. Just wanted to see if anybody else felt differently...so I don't feel like an @ss lol.

Ya, it does suck for her but it happens. 60 days later is way past the time you could be held responsible for it.

I also agree. You shouldn't feel obligated. I understand how you feel, I too would at least feel remorse for her but...it is what it is. 30 days.

    I disagree.
The implied and expected warranty on these sort of things is Forever.

You should take the phone back, and replace it with a Brazillian model.

If you purchased it from anywhere other than apple here in the UK (for example O2 / Vodafone / tesco) standard policy is 28 days for faulty. After that it's apples responsibly for the warranty, do I wouldn't sweat it. I would hesitate to offer a repair even if she pays for parts given you may not be able to repair or may make it worse (going on my repair skill here ) Tell her her apple store is the best bet....
