Drop the ringtone files in iTunes (Ringtones), then sync is the easiest way.

Make a folder called "Your Theme name.theme" and make another folder called "UISounds", and/or drop into main theme. Inside that place and name correctly all your .caf files.

They would only be activated by WinterBoard, you said you wanted them in a theme.
If you convert them to m4r, you can SSH them to /private/var/stash/Ringtones.

In the theme do they need to have a set name or folder to activate them?

This is an example, how they are named and this type of folder can just be placed in your themes main folder.

Thanks a million that's sorts the sounds out but what about the ringtones for incoming calls?
How do i add custom ringtones using a theme is it the same folder with different names or is it somewhere else?

    EXAMPLE:
    Folder name = Ringtones
    Song name = asong.m4r
