Likelihood of replacement device with iOS6

My 4S has one week left of warranty, so im getting it replaced before it runs out.

Im booked in for Sunday at noon.

My question is, what is the chance of getting a device with iOS5.X or iOS6?

I've rang Apple and they said they can not comment.

Thoughts?

depends on how old of stock the store you visit has. I'd imagine that with the turnover rate of Apple's stock you're going to get a fairly recently manufactured phone, which would have iOS 6.

bare in mind these are refurbished phones that come in the little black boxes...

I NEED a jailbreak on my phone, so when they show me the 'replacment' ill check the firmware first, if its iOS6, ill explain ill keep my phone
