I was on 5.01 software and my phone was jailbroken. I had a problem that caused to me restore and lost the jb because I had to upgrade to 5.1. I was having problems with my phone and just received a replacement phone from VZW that came with 5.01, so I am happy that I can jb again, but I am running into a problem. Before I activated my new phone, I backed up my old one and when I went to restore my new phone, it said that I first need to upgrade to the new software. Is there a way that I can get all my old settings on my new phone without upgrading because I want to jb it? Thanks

I think he wants to have his old things back in the new phone...the thread title is different from what the thread says IMO

Yes, I would like to restore from a backup of my old phone and get all my ringtones back on, apps in folders, alarms and other settings, but I don't want to upgrade to 5.1 because I want to be able to jailbreak it. Sorry if the title of the thread is misleading.

When I click on restore it tells me that I have to upgrade the software in order to restore from a backup.

Not 100% sure if you will be successful, but you might try right clicking on your Phone in the left panel in iTunes and choose restore from back rather then clicking restore.
