Can you avoid being upgraded to 5.1 iOS when I activate the new iphone 4S? I'm pretty sure that the new phone is going to have at least 5.0 or 5.01, it will not have 5.1 as I'm getting it from Best Buy on exchange and the replacement phone has been in thier stock for awhile.

Nope, you get what you get, but the chances are still pretty good that you may get a new phone with 5.0.1 on it. I had a friend just get one yesterday, at Best Buy in fact, and it was on 5.0.1

My dad got the 4s today and has 5.0.1 so got better luck gitting it I guess

I understand you get what you get, I know this phone has been with Best Buy for sometime, it's a 64 GB iPhone 4S they had to ship from their store in Alaska because they don't sell very many of them, so I don't think it's going to have the 5.1 iOS because it was manufactured before 5.1 came out.
My question is when I activate it, is Apple going to force the activation to upgrade it to 5.1 if it shipped with 5.0 or 5.01?

No, you can stay on the IOS for as long as you desire.
Just do not update in iTunes, it will ask you.

Thanks that's the information I wanted to hear. Yay! I wasn't happy about the possible loss of being able to jailbreak.

I went to the apple store to have my contacts switched over to my new phone (4) 5.0 and the lady hit the upgrade on me, now I'm like wtf? I'm on 5.1 now but I still have my old phone (4), my Q; my old phone , if reset, which it is, will it automatically upgrade to 5.1? Smdamnh.
