When was the last time you backed up and re booted ?
Re boot tends to make your phone more efficient after you have installed a lot of things.
I would try this first and then let us know if it is still happening ?
Have you got an unlock (ultras0w) running as this will effect the battery.
you may have to restore to sort these things out and go to 4.1, so have you got shsh on file ?

yes i have shsh on file with cydia but i have never used it so i have no idea how it works,so how do i upgrade to 4.1 without messing it up?

You need to do the following.
1. download 4.1 firmware for you phone
2. Download the latest Tiny Umberella
3. Download the latest iTunes
4. Download Limera1n or greenp0ison.
Then when you have all these and you have installed iTunes and TU.
Connect your phone and run TU pointing it to 4.1
Then click shift+restore (Windows) in iTunes and point it to the 4.1 you downloaded,
When the phone has finished its restore i would set it up as a new phone, you will have to put your contacts in again and your mail accounts, but always better to set up as a new phone, i know its a pain in the ar** but better.
Then when you have done all this Jailbreak with Limera1n or greenpois0n.
But most of all i would make sure that you read a few guides (Google it)to make yourself confident with what you are doing, And ask questions if unsure. Its not hard but you need to be sure as its not our phone
