Brand new iPhone 4 from AT&T and it has someones iTunes account already....

I just bought a BRAND NEW iPhone 4 from AT&T and I went to the AppStore and it already has someones iTunes account saved? Is it safe to say this is either used or been played with already?
I went into AT&T today and signed a two year agreement and bought what I thought was a new iPhone 4. She went in the back and came out with a iPhone 4 box, but I didn't see the plastic that seals the box. I didn't think anything of it until I tried downloading an app and it asked for a password. There is already an email address saved for emails, itunes account and game center...
Update:
I went to AT&T and told them what's happened and they gave me a brand new without any questions.Last edited by MeRyanSch; 10-03-2010 at 01:51 PM.

No. I just signed a two year agreement and she went in the back and came out with this phone. I saw her take it out of the box, but didn't see her break the seal of plastic around the box.

Do you think they'll accept my story? I'll go to the same AT&T store and talk to the women I bought it from. I should have known when it wasn't the plastic.

If not then I would ask to be refunded and go to a different store. Don't the sales people get commision for items?

^ of coarse they get paid commission. Good idea, refund and go somewhere else if they don't play nice.

Your not breaking any ETFs or anything because you just got it. That is if they say no to changing it out for a actual new one.

If it looks new and check if there is shsh blogs for 4.0 or 4.0.1, if there is ,I would keep it.

It was laid out like a stock iPhone comes. Everything on the first page with contacts on the second page. It still have the plastic around the phone itself and the cable and headphone are wrapped still.
Other than the email
It was at Apple.com it was at amazon.com when I opened safari

if they activated it on itunes, and it synced to the itunes account, that would happen. ive activated several brand new phones on my computer (no syncing), and when i would go to appstore to get the free case app, my itunes email would be present asking for password....
its definitely just the point of activation, they shouldnt have any backups on their computers they use to activate, but maybe one of the employees synced a clients phone by mistake before serving you

You should have got a brand new phone. However if something went wrong with it then your second phone would be a refurb.... I am sure AT&T will give you a new one... they have been wonderful to me when ever I needed to contact them.
