Then, you don't have it, you can take it back for an exchange.and wait for the new jailbreak. Save your 4.1 when you get your replacement the same way you do with 4.0.1 but now 4.1 for future restore.
If it is faulty, you will qualify for an exchange with no question asked. Apple is pretty good with the customer satisfaction.
