Sneak around upgrade

Alright, so if someone could please tell me if this would work it would be great.

So i have a iphone with a plan not eligable for the upgrade till 2011. My mom's two year contract is running out late next week. Since she would then be eligible for the cheap $200 iphone4 package, would it be possible to:

1. Get the Cheap iphone package for her phone.
2. Pretend as if she didnt like it so she wants to downgrade back to her old phone
3. I just simply pay the $18 upgrade fee and take over the iphone.

Would this simple work trick work? as far as i can see i would end up paying 232 (two upgrade fee's), still obviously much cheaper then the 400 with no plan.

You can upgrade her line to the new iPhone for $199/16gb and then she can give it to you and you can walk into the store and have them issue you a microsim with your phone number on it. She will have to go back in and get a new regular sim for her old phone when she switches back. It is not sneaky. Many many many people do this. AT&T doesn't care.
