Could I just Hactivate the iPhone 4 and save myself 200 dollars?

I am of the unfortunate bunch that does not have a upgrade this year, and Im wondering if I could simply purchase the phone from apple and hack it at home. I already have the 3G unlimited data plan.

I guess my biggest worry is AT&T finding out somehow.

So, Couldn't I just activate it and save my 200 bucks?
And Is there any way AT&T would find out?
