    Default Replacement phone firmware?

    So i wanna get my phone replaced from apple but I don't want the firmware to be 3.1 because of the inability to Jailbreak/Unlock. Are the replacement phones apple gives out on the latest firmware or what?

    Most likely you will get the latest firmware but there are a few incidents of people getting old firmwares (I highly doubt it).
    I always feel sorry for the guy in the iPhone commercials. He always gets a call right in the middle of trying to do something
