Ok, if I wanted to buy an unsubsidized iPhone 3GS from the Apple Store, would they let me do it?

And if they allow me to, will they or can they unlock it for me?

No Apple will not let you do this. If do not have a contract with them. It won't happen. I tried to do this last saturday and was told I could purchase a gift card if it was a gift or purchase the new phone at full price under my current contract. I did purchase the phone, at full price. I also jailbroke, unlocked and mailed it to Spain.
