ATT doesn't care what you do to your phone as long as you follow their contracts.
Personally, I would be more worried about getting hit with a huge data bill for using jailbroken apps that stream constantly than having ATT disable your device for having it modified. Lol.

There is a legal difference between a TOS (Term of *SERVICE*) and End User Licensing Agreements. TOS is for a service that I pay for ongoing, EULAs are for things that you buy.
As of this date, no one has ever proven that a EULA can really hold up in court. Otherwise, when you buy a car, they would have an EULA saying you could only take it to the dealer for service.
A TOS involves an ongoing service. You have a TOS agreement with AT&T (if you use AT&T) that says you will not misuse their *SERVICE* not the iPhone. You have no TOS with Apple.
Just the other day I was standing behind someone at Home Depot that told security to call the cops if they wanted to see his receipt or look in his bags. He was a lawyer and basically said "once I pay for it, it belongs to me, and you have no right to search it, or even write on my receipt. Call the police and tell them to come here and determine probable cause. In the meantime, I'm going to sit over there and type out my complaint for false imprisonment." It was a beautiful sight to see, wish I hadn't been in a rush or I would have stayed just to laugh at the store.
