possible stolen iphone

this guy i know told me he would trade me an iphone for my ipod touch. The only problem is it may be stolen. If it is can att or apple deactivate it or can i get into any trouble with it. im already an att customer and i was just going to put my sim card in it.

They can't turn it off... there's no way to prove it was stolen.

if its protected by a password or something can i just restore it to be able to use it. idk if it is or not but he wants to trade tommorrow and i dont want to be bleeped over.

If it's stolen property, why would you even consider trading for it? And if it's protected by a p/w, no you can't "just restore it" unless there is a jb app that works around it. That's the whole point of a password.....you could try all 10,000 combinations though.
