Ok so I purchased my unlocked Iphone off ebay. I checked the serial # and its never been activated. My home button completely stopped working (hardware issue). If I restore the phone to original settings will I be able to swap it at the local apple store?

Depends on the genius, restore, virginize if you want, then bring it, if they ask for AT&T number, no help, you can always do it yourself, thats what i would do.
