  • Class Action Lawsuit Against Apple & AT&T Over 3G Data Plan
    Well looks like the big boys (lawyers) are behind iPad owners who feel that Apple and AT&T baited them into buying the iPad 3G with the promise of the unlimited data plans. Little old me is included in this craziness. On June 9 against Apple and AT&T over the discontinued unlimited-data plan for the iPad 3G has been amended and re-filed to include additional iPad 3G customers.





    One of the lawsuits main contentions involves AT&T and Apple’s claim that iPad 3G customers could easily opt-in and opt-out of an unlimited data connection on the iPad 3G without any penalty.

    We all know AT&T's new data plans since they changed them on June 7th so I won't go into that again however I just got the email conformation that I bought my iPad 3G in time and I am now on the unlimited plan. Apple and AT&T both had to approve this making sure I bought it before June 7th.

    As usual Apple and AT&T have not commented on the class-action lawsuit or its implications. It's possible that if a jury finds the case in favor of the plaintiffs, that AT&T may be forced to bring back the unlimited data plan as an option. Years from now, when the litigation of the case is over, the iPad 3G will probably be a historic curiosity, replaced by another Apple device using different wireless technology.

    The case, filed in the United States District Court in San Jose, Calif., represents customers from several different states. The suit also says that AT&T was abrupt in its changes, giving customers less than a week’s notice that the data plan would be eliminated.

      People that say they don't use 2Gigs a month don't deserve to have a smartphone... a real smartphone user reach 2Gigs in couple of weeks unless he/she is always on wifi.

      nope, no tethering at all... im on the go a lot so I use my iphone constantly to check stocks and business news a lot along with cruising the internet and other apps that utilize data (Im constantly on my iPhone reading news releases and using safari, so if my 800mb in a few days seems extreme or unlikely, well then your not me nor are you in my line of work).... plus Im not paying for tethering, ill patiently wait until a proven jailbreak has been released along with a tethering hack (sorry mods about the "hack" comment, but who doesnt have a tethering hack on their jailbroken iphone?? Its almost as essential as winterboard)

      its almost discouraging now to embezle your money into apple and at&t. they are making everything so complicated...why cant tmobile or verizon have been the ones to get apple....

      im a graphic design and business student and i go WAY over 2gb in less then a month. its seriously a joke to put a cap at 2gb. luckily im grandfathered into having my unlimited plan until my contract expires. when it does byebye at$t. hopefully tmobile wins the next contract

      I think all wireless carriers should just remove the fine print and just accurately describe the plan. If its unlimited then leave it that way, if they want to put a cap then create a separate plan for that. Of course that's in an alternate dimension so I'm not expecting it lol

      I agree!! WTF does unlimited data mean anyway!
      I guess ATT and Apple will be arguing about what the word "is" means ...?

      My wife thinks she uses 2gb+ a month because she uses pandora, facebook, uploads tons of youtube vids, yaaa... 600mb last month...

      Definitions of unlimited on the Web:

      * having no limits in range or scope; "to start with a theory of unlimited freedom is to end up with unlimited despotism"- Philip Rahv; "the limitless reaches of outer space"
      * outright: without reservation or exception
      Hope they lose the case. Its just plain deceiving to have someone spend $500-800 on device, and get ripped off like this. Same with the iphone plans.

      I don't agree with everyone talking about if you go over 2gigs you aren't using your iDevice like it's meant to be used. I do though think it is really easy to go over. Last month I had just over 11gigs of data used. Hey I like movies and t.v. shows. Don't have time to watch at home and love playing with all sorts of themes and cydia apps. So I am constantly on my iPhone and over 3G (Work wifi is a hit and miss throughout the building).

      I cant stand this new "grandfathered" term AT&T uses now! It's such a scam, AT&T knows that if it would have changed Unlimited on everyone there would have been a riot! So they are doing it slowly, if you change anything in your plan use loose the unlimit. Who does that!? At the moment me and my wife decided that 550 combine talk is not enough, guess what, I'm suck with 550 for 2 years. If I upgrade to more minutes, I get my unlimited taken away!! Lol... What a joke. Grrrrrrrr

      I too disagree with the statement about people who use less than 2gb a mth are using there phone wrong, I usually chime in at about 1gb myself. And I'm constantly using my phone for (same as you) checking news, reading about new technoloyy, messing with new stuff in cydia (hll I probably use more then 2gb a mth just on cydia refreshing lol), but 90% of the time I'm on wifi, so even tho I'm 'grandfathered in, it's not a big deal for me.

      With all that said I do believe the way AT&T suddenly changed the data plan is bullshyt.

      I'll have to agree. I think they should sue them. I also think they should be sued for unfair pricing.
      Smartphone data plan 200mb for 15.00.
      iPad data plan 250mb for 15.00.

      Is AT&T claiming the data on a smartphone is more expensive than on the iPad? Last I checked they all use the same network for data. So how is it iPad owners get 50mb more a month for the same price? AT&T is a bunch of crooks, price gouging their customers.

      If the suit is successful it will only apply to those who ordered before the change in plans.

      Lol, you are leaving out the main reasons for your high bandwidth usage. News releases, standard safari, stocks get you nowhere near that type of data usage.

      Which would be? I didnt sign up for the tethering option (plus I wasnt even asked if I wanted it when I got my iphone which i found odd,,,maybe because I was at apple and not ATT)... I just checked my data and it says 768mb... I dont know how they calculate data used between the apps, safari and other features. Does data over wifi networks calculate into my already high MB usage? If it does then that might be the main reason I, as you put it, was "leaving out". But in all honesty, I am always on my damn phone in fact my buddies said they were going to have an intervention for me and seen of IA (iPhone's Anonymous) lol...

      Plus, if the wifi part is the reason for the MB usage, then that makes senese because I was trying to figure out yesterday if it was just that the new iPhone uses much more data for season as compared to my previous 3G model or if I really am using that much data, plus I had tethering on my 3g and I dont remember using this much data even though I never used the tether option much at all....Thank god I got to keep my unlimited data plan and wasnt forced into the new school options because I would be SOL really fast via my data allotment and forced to pay the fees.




      Edit** Wait a tick... I think I just got what you were alluding to in your post...you were alluding to porn im assuming....lol.....

      ^ Maybe because Apple and AT&T are keeping track of you on the new iPhone, thats the reason of the data usage!!...lol Wouldnt put it past them to do something just to raise the usage of your traffic. Some people should get together and test the theory.

      Good to hear! I don't see why AT&T can't keep around the $30 Unlimited plan. Having smaller plans will help reduce bandwidth, and make some of your customers happy. Rather then just making a bunch of them mad.

      so let me get this straight, for $35 I only get 3gb of data usage? If thats true, does that suck or what? I mean at&t should have unlimited and the 2gb plan. What is the point of the buying the 3gs and iphone 4 if you can use them up their potential?
